PRIVACY POLICY 

We respect your privacy and are committed to protecting your personal information. This Privacy Policy [hereinafter "Privacy Policy"] will provide you with information about how we handle your personal information. You will also learn about your rights and how applicable laws protect you and your personal information. Please read the Privacy Policy carefully before using our Services [as defined below in the Privacy Policy]. By using the METEOTRACK Sites [as defined below in the Privacy Policy], you agree to the terms and practices described in the Privacy Policy.
 

The Privacy Policy applies to any products, services, content, functionality, technology or features, and any related websites, applications, APIs, software or other online services that we offer (collectively, also the "Services").
 

The METEOTRACK Sites and the products, Services and advertising made available through them are not intended for use by children under the age of 18 without parental supervision. The Administrator does not intentionally collect any information from children under the age of 18. we undertake to delete any data from such users if a parent or guardian has notified us that such data has been obtained.

GENERAL PROVISIONS

The administrator of the personal data is METEOTRACK Sp. z o. o. with its registered office in Krakow, 18 Zduńska Street, premises M1, Krakow, Poland e-mail: office@getmeteotrack.com entered in the Register of Entrepreneurs under KRS number: 0000808920, for which the registration files are kept by the District Court for Kraków Śródmieście in Kraków, XI Economic Department of the National Court Register, NIP: 6762572614, ] (hereinafter referred to as "Administrator" or "Company" or "METEOTRACK"). 
Personal data of users, understood as users, visiting the METEOTRACK Sites, including using the Services, singular or plural, who interact with the METEOTRACK Sites [hereinafter referred to as "Users"] of the Company's website, API or applications of the Company under the name of METEOTRACK [hereinafter also referred to as "Applications"] shall be processed respecting the principles provided for in the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016. on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as "RODO"), as well as those provided for in Polish laws, including the Act on Provision of Electronic Services of July 18, 2002 (i.e.: Dz. U. of 2020, Item 344, as amended).   
In order to implement the statutory requirements, the Administrator shall select and apply appropriate technical and organizational measures to ensure the protection of the processed data, and shall protect the data from being made available to unauthorized persons, as well as from being processed in violation of applicable laws. The above applies to all METEOTRACK Sites, understood as all METEOTRACK websites, APIs, digital products, Services, applications, data, content, advertisements and other similar elements (including but not limited to registration screens, contests, data entry and tracking and other interfaces) [hereinafter also as "METEOTRACK Sites"].

BASIS FOR DATA PROCESSING

The Administrator only processes personal data that the User has provided in connection with the use of the METEOTRACK Site. The Administrator's processing of personal data for:

registration of an account on the METEOTRACK Pages of the Administrator, where the basis is Article 6(1)(a) of the RODO, i.e. the User's expressed consent to the processing of such data, confirmed by acceptance of the content of the Privacy Policy or other documents from which the User's rights and obligations arise, with which the User has the opportunity to become acquainted before acceptance (data scope: name, surname, e-mail address, telephone number), 
execution of orders regarding the Services, where the basis is Article 6(1)(b) of the RODO, i.e. taking actions necessary to conclude an agreement the subject of which is the execution of a Service (e.g. placing an order, issuing a bill/invoice) and the necessity of its execution by the Administrator on behalf of a given User (scope of data: name, surname, e-mail address, telephone number),                                   
necessary for the fulfillment of the legitimate interests of the Administrator, including the conduct of marketing activities and advertising campaigns for the Administrator's products or services, among others, electronically, on the basis of a separate consent given by the User in accordance with Article 6(1)(a) of the RODO, i.e. the User's explicit consent to the processing of such data given using the interactive forms posted on the METEOTRACK Sites (data scope: first name, last name, e-mail address, telephone number),
claiming receivables, where the basis is Article 6(1)(f) RODO (data scope: name, surname, e-mail address, telephone number, other data necessary to prove the existence of a claim or defense of rights),
use of telecommunications terminal equipment and automatic calling systems for direct marketing purposes in accordance with Article 172 of the Act of July 16, 2004. Telecommunications Law (Journal of Laws of 2021, item 576). 
The Administrator processes personal data voluntarily provided by Users and data collected automatically from the use of the METEOTRACK Sites in accordance with Article 6(1)(f) of the RODO, i.e. due to the legally justified purposes pursued by the Administrator, and in particular for the purpose of direct marketing of the Administrator's products or services, as well as for the purpose of optimizing, improving and personalizing the functions of the METEOTRACK Sites and for the purpose of creating statistics. The Administrator ensures that such processing will not violate the rights and freedoms of data subjects (scope of data: name, surname, e-mail address, address, telephone number, employment data, other data provided in the course of contact with the Administrator).
Personal data provided voluntarily by the User are not combined with automatically collected data on the extent of the User's use of the METEOTRACK Sites. The Administrator informs that due to technical reasons such a combination may occur, however in such a situation the data so combined will be processed by the Administrator only for the legally justified purposes carried out by the Administrator, and in particular for the purpose of optimizing, improving and personalizing the functions of the METEOTRACK Pages and for the purpose of creating statistics for the internal needs of the Administrator.
With the User's separately expressed consents, his/her personal data may be processed for the purpose of sending him/her commercial information about the Administrator's Services by e-mail. The User has the right at any time to request to stop sending him/her commercial information by e-mail or to stop using his/her phone number for direct marketing purposes.
Data processed in connection with placing orders and concluding contracts will be stored until the statute of limitations for claims under these contracts. Due to the need to fulfill obligations of a tax and accounting nature, some personal data will be kept for a period of 6 years from the date of termination of the Services.
Data processed for the Administrator's marketing purposes by electronic or other means used by the Company will be processed until any withdrawal of relevant consents.
Personal data obtained for the purpose of contacting the Administrator will be processed during the period of conducting this contact, and later will be archived for a period of 3 years from the end of the contact, which is justified by the need to reconstruct the content of such contact in connection with the assertion of possible claims.

PURPOSE OF DATA PROCESSING

Each time the purpose of processing, the scope of personal data and possible recipients of personal data of the User who provides the data to the Administrator for processing result from the User's consent or legal regulations, additionally, the data may be further specified as a result of actions taken by the User on the METEOTRACK Sites or through other channels of communication with the User.
The Administrator indicates that it uses the collected purposes to:

Provide weather warnings to the User at the location(s) he/she provides to us;
Provide a more accurate way of providing the Services;
Provide User-friendly and engaging content that we believe will be most relevant to the User;
Provide you with targeted advertising that we and our suppliers believe will be most relevant to you. Providers in accordance with the Privacy Policy include, but are not limited to: service providers, advertisers, vendors, data collection providers and other third parties [hereinafter collectively or each individually as a "Provider"];
Analyze traffic and usage of the METEOTRACK Sites;
Provide up-to-date information about our products, Services and METEOTRACK Sites;
Provide access to the METEOTRACK Sites based on subscriptions;
Process and verify subscriptions;
Issue bills for METEOTRACK Sites subject to paid subscriptions and other services;
Process Users' access requests and requests to remove access.

TYPE OF DATA PROCESSED

When using the METEOTRACK Sites or Services, personal information or device information, including device location, may be collected. Users are informed during the registration process or use of the METEOTRACK Sites about the information we may collect about them or their devices, and asked to provide this information or allow us to access it for certain purposes, such as improving products and sending notifications.  

We may ask you to provide personal information or allow METEOTRACK and/or Suppliers to identify or contact you. We may ask for such information when we ask you to register for paid Services, although some free products or Services may also require registration. For example, we may ask for your personal information when you create an account, download applications or content through the METEOTRACK Sites, upload content (e.g., photos, videos) to the METEOTRACK Sites, subscribe to email newsletters or other content provided by the METEOTRACK Sites, or report a problem with your account or the METEOTRACK Sites. As a registered subscriber or User, you may be able to download software, enter contests or sweepstakes, order email newsletters, or participate in additional services or other promotions offered on the METEOTRACK Sites.

Your use of the METEOTRACK Sites may result in the assignment of unique identifiers (IDs) to you. Some of these IDs are generated by your device and some are delivered to your device by us or our Providers. They may be in the form of numbers, combinations of letters, numbers and other characters or other codes. They may be used to enable METEOTRACK and its Suppliers and other entities that assist METEOTRACK in operating the METEOTRACK Sites to know the location of your device, your browsing movements or information about the environment near your device. When using certain METEOTRACK Sites, you may choose when and how often you want to share your device location data with us, and for what purposes we or our Providers may use your device location data. The basic functionality of the METEOTRACK application will continue to work if you choose not to share your device location data in order to receive personalized content and advertising. 

When using the METEOTRACK Sites, your device may come to send us some or all of the following information:

1) GPS coordinates of your device. On many devices, enabling or disabling "Location Services" or similar settings allows you to control whether your device sends GPS coordinates;
2) Internet Protocol (IP) address. An IP address is a number automatically assigned by your ISP. The IP address is used to send information to us or our Providers and to receive information back from us or our Providers;
3) Device ID. A device ID is a combination of letters and numbers that is unique to the device you are using. The device ID identifies the device, regardless of who is using it. In many devices, the device ID is provided by the device manufacturer and stored permanently in the device's memory. Depending on how the manufacturer has configured the device, it may not be possible to change it;
4) Advertising ID (IDFA) or Advertising ID (AAID). These are combinations of letters and numbers that are unique to the device in use. However, these identifiers may not be permanent. Depending on your device, you may be able to reset them in your device or browser settings;
5) information about other devices in the vicinity of your device. Your device typically uses several types of wireless communication methods, and each method is enabled or disabled separately by you. If you use a wireless or cellular connection, your device may record and transmit information about your contact or connection with other devices or elements of the network your device uses;
6) Information about the operation of the device. This may include such information as the amount of power consumed by the device, the operating system and its version, and the version of our application used by the device; 
7) Cookies. Cookies are files containing small amounts of data that may contain an anonymous, unique identifier. If you access the METEOTRACK website using a web browser, including browsers on mobile devices, cookies may be sent to your browser and stored on your device. This allows the device to be identified the next time the browser accesses the METEOTRACK website. The user can configure their browser to reject all cookies or to notify them when they are sent. However, if you do not allow your device to accept cookies, your experience the next time you visit the METEOTRACK website may not be optimal, as we may not recognize your device;
8) Pixel Tags, Web Beacons, Flash Shared Objects/HTML5 Local Storage/HTML5 Mini Databases. Many mobile devices are using these technologies to store information on mobile devices, and as a result, they allow us to improve web browsing. Flash Shared Objects, HTML5 Local Storage and HTML5 Mini Databases also allow a device to track a user's movements while browsing the Internet, rather than just one specific site.

If the User disables "Location Services" or a similar setting that controls GPS functionality, the device can still automatically send or receive other information as long as the User has these other types of communications enabled. Please refer to the instructions for your device, operating system or browser to learn how to control the information your device can send.

You may/potentially will be able to upload information about yourself and your surroundings, such as observed weather data, your current location or other location of interest. You may also upload or submit photos, videos, graphics, information, comments and other content [collectively, "Content"] to the METEOTRACK Site. With the submission of such Content, you grant the Company a royalty-free, worldwide, perpetual, non-exclusive, transferable license to use, reproduce, modify, edit, publish, distribute, publicly display, sublicense, translate, create derivative works of such User Content through the METEOTRACK Site or those related websites or applications hosted by the Company. They may be viewed, read, collected or used by others, beyond our control, including geographic location, tags and other metadata. 

You may/potentially will be able to engage with our content through social media or other third party platforms such as Facebook, Twitter and others ["Social Media"] that are integrated with the METEOTRACK Sites. When you have the opportunity to engage with our content on or through Social Media, we may have access to certain information contained in your profile on the relevant Social Media platform if you have enabled the sharing of your profile data. This may include your name, email address, photo, gender, date of birth, location, ID associated with your Social Media profile, user files, photos and videos, friends or connections list, people you follow and who follow you, posts, "likes" and more. You should review the privacy policies and terms of use of the Social Media platforms you use, and check the privacy settings on those Social Media platforms to ensure that you allow those platforms to share only the information you want to share.

In the course of the User's use of the METEOTRACK Products and (if applicable) the METEOTRACK Weather Station (understood as a device for measuring meteorological/weather data), non-personal information, data, news or any other material in the form of, but not limited to: time, date, temperature, forecasted or occurred phenomena [hereinafter referred to as "Weather Content"] will or may be transmitted . Weather Content, at the time it is provided to METEOTRACK, shall be its property in accordance with the terms of METEOTRACK's Terms of Use.

Information provided to METEOTRACK by the User when contacting us directly. If you contact METEOTRACK, we may retain a record of that contact or correspondence.

SMS/text messages from a mobile device. You may consent to receive SMS/text messages from METEOTRACK. If you do so, we will not sell or disclose your SMS/text message data or consent to receive SMS/text messages to third parties. 

DATA SHARING

For the purposes for which we process personal data, the Administrator may share your personal data with the following categories of recipients:

Related companies: We may share data with other companies in our corporate group that help provide services related to our business operations. Any sharing of personal data with companies located outside the EEA, is done with appropriate safeguards, or is subject to a data transfer agreement that clearly defines the obligations of the parties and provides for appropriate technical and organizational measures used to ensure the security of your data. 

Third-party service providers: We use third parties to help provide us with certain solutions related to our Services, as well as to maintain and monitor our Services, e.g., cloud storage. 
Marketing and analytics service providers: In order to improve our Services, we may share your information in non-identifiable form with analytics providers that help us analyze how users use our Services/Portal and to improve our Services and also to support our online marketing and interest-based advertising. For the purposes of monitoring and reporting on the effectiveness of our business partners' campaigns and for internal business analysis purposes, we may share information with them in a way that does not identify Users. 

Payment service providers: in order to provide the payment services made available on our Portal, we transfer User data to the payment provider indicated at the time of payment. The scope of data transferred for this purpose includes your name, internal transaction identifier, transaction amount, email address, phone number, name of the service ordered, amount of payment due to us, and device identifier. The payment operator becomes a separate controller of this personal data.

Law enforcement, supervisory authorities and others: We may disclose your personal data to law enforcement authorities, supervisory authorities, public authorities, entities performing public tasks or acting on behalf of public authorities, and other third parties. Disclosure of such data is made in connection with the performance of legal obligations.

TRANSFER OF DATA TO THIRD COUNTRIES

Personal data is not transferred to countries outside the EEA. In situations where data will be transferred outside the "EEA", we ensure, an adequate level of protection, i.e. we will transfer Users' personal data only to countries that have been recognized by the European Commission as providing an adequate level of personal data protection. In the event that a transfer of User data to a third country outside of the list published by the European Commission occurs, we will inform and request separate consent for such transfer.


USER RIGHTS

Each User whose personal data is affected is entitled to:

access to his/her personal data,
to rectify his/her personal data,
to request the deletion of his/her personal data,
to request restriction of processing of his/her personal data,
The right to object to the processing of their personal data,
The right to lodge a complaint with a supervisory authority.
Right of access to personal data. This right allows you to be informed whether we process personal data about you, and if so, the right to receive a copy of the personal data we process. The right to access your personal data allows you to verify whether we are processing it lawfully.
Right to rectification of personal data. This right provides you with the ability to request the correction of incomplete, untrue or outdated data that we process. In some cases, in fulfilling your request, we will have to verify the accuracy of the new data you provide to us.
The right to restrict the processing of personal data. This right allows you to ask us to stop processing your personal data in the following situations: (a) when you want us to verify the accuracy of the data; (b) when our processing is unlawful; (c) when the data is needed to establish, assert or defend a claim, even though we no longer need your data for our own processing purposes; (d) when you have objected to our processing, but we need to verify that we still have an overriding and legitimate basis for continuing to process your personal data.
Right to erasure of personal data. This right allows you to request the erasure of your personal data if it is no longer necessary for the purposes for which it was collected. You may also request that we erase your personal data if you have successfully exercised your right to object to processing, if we process your data unlawfully, or if we are required to erase your personal data in order to comply with a legal obligation indicated by applicable law. In some cases, we are obliged to process your data under applicable laws and it will not be possible to fulfill such a request.
The right to object to the processing of data concerning you in situations where we process the data based on the premise of legitimate interest (ours or third parties). The right to object can be filed on grounds related to your particular situation, when, in your opinion, the processing affects your rights or freedoms. You also have the right to object if we process your data for marketing purposes. In some cases, we can demonstrate that we have legitimate grounds for processing that override your rights and freedoms (e.g., the need to ensure the security of the METEOTRACK Sites and to prevent fraud). In such cases, the right to object is not combined with the deletion of the User's personal data. The User also has the right to object if we process personal data for direct marketing purposes. 
Withdrawal of consent or objection to the processing of personal data is made by sending a message to the email address: office@getmeteotrack.com .
In case of any irregularities in relation to data processing by the Administrator, the User has the right to lodge a complaint to the President of the Office for Personal Data Protection - the supervisory authority in Poland.
Contact with the person supervising the processing of personal data in the Administrator's organization is possible by e-mail at: office@getmeteotrack.com .

Accessing and updating your online account information. If you have a subscription or account with us in which you have voluntarily provided your information via email, registration forms, the best way to access or control this information is to visit the relevant METEOTRACK Site to update your online profile, change your password. If you have a username or password associated with your account, you are responsible for maintaining the confidentiality of your username and password.

TECHNICAL AND ORGANIZATIONAL MEASURES 

We store all information, received from you, on secured servers. We also aim to implement the necessary technical and organizational measures to protect your data. METEOTRACK sites constantly assess the degree of security within their network and monitor internal regulations and procedures designed to :

protect data from accidental or unlawful loss, access or disclosure,
identify foreseeable risks to the security of METEOTRACK Sites' networks, and 
minimize security risks, including by performing risk assessments.

TRANSFER TO THIRD PARTY SITES

You may request access to certain products or services from the METEOTRACK Sites that are available through third parties, either through their own websites or websites hosted by us on or linked to the METEOTRACK Sites. When ordering, registering or purchasing products or services from these suppliers, you may be entering into a contract with the supplier, not the Company, and the supplier's terms and conditions may apply. These terms and conditions may differ significantly from this Privacy Policy and other terms and conditions on the METEOTRACK Sites. You should read and understand the suppliers' terms of use and policies before using their sites or entering into agreements with them. If you have questions or concerns about their sites, terms and conditions or privacy policies, you should contact those providers directly. The Administrator assumes no responsibility for the content of the above-mentioned supplier's sites, products or services. For convenience, we may provide information and contact details of these suppliers, but we cannot assure that the contact details are correct or accurate. 

USE OF COOKIES AND OTHER TECHNOLOGIES

Subject to the consent of the user of the METEOTRACK Site, the Administrator may store certain information on your computer using cookies. Cookies are a small file stored on the User's device, which stores settings and other information used on the pages visited by that User.
Cookies are used for, among other things:

helping the User log in (e.g. remembering the User's name if the User registers or logs in); 
remembering some of the User's preferences. As part of these activities, information may be collected about when and for how long the User visits our sites, information about the User's browser history and language preferences;
to assist the Administrator in improving the METEOTRACK Site, including developing our security measures and detecting illegal activities;
providing personalized advertising. Cookies help us determine the advertisements the User sees and measure their effectiveness.
The Portal uses/may use the following categories of cookies:

functional cookies - these are cookies necessary for the operation of our Services, i.e.: to store certain information (e.g. language preferences), to remember preferences set, etc.,
analytical cookies - these are cookies that are used to collect information about how you use our Services and visit the METEOTRACK Sites (duration of navigation, pages visited, link clicked, referring pages, etc.),
Personalization cookies - we use cookies to improve the relevance of the opportunities displayed on our homepage based on how you interact with the METEOTRACK Site. We use cookies to make promoted opportunities on such sites more relevant to you, of value to our partners,
essential cookies - these are cookies that are necessary for the operation of the METEOTRACK Site. They are used to log in, stay logged in, anonymously measure our traffic and ensure the security of the site. Without this type of technology, our services will not function properly or we will not be able to provide certain functionalities.
In many cases, web browsing software (web browser) allows cookies to be stored on the User's terminal device by default. Users of the Site may change their cookie settings at any time. These settings can be changed, in particular, in such a way as to block the automatic handling of cookies in the settings of the web browser or inform about their placement on the Site user's device each time. The User may give the consent referred to above through the settings of the software installed on the telecommunications terminal device used by the User or the configuration of the service - i.e.: to disable or restrict the use of cookies, the User may change the settings of his/her Internet browser. However, the consequence of such action may be malfunction or loss of access to some subpages of the METEOTRACK Site;
We also allow the use of technologies such as Pixel Tags, Web Beacons, Flash Shared Objects/HTML5 Local Storage/HTML5 Mini Databases. Many mobile devices use these technologies, which allow information to be stored on mobile devices and, as a result, allow you to expand your web browsing experience. 
As a rule, cookies on a device are removable - as a general rule, all you need to do is clear your browser's browsing history, although the delete option may depend on your browser provider. This removes cookies from all sites visited. Note, however, that you may lose stored information (e.g. saved login data, page preferences) in this way.
